The purchase of products from this web site is governed by these terms and conditions. By accessing the site you agree to be bound by these terms and conditions. Contained in our terms and conditions are details of current regulations governing online shopping. Please read them carefully as they contain important information. If you intend to purchase from our site we recommend that you print a copy of these terms and conditions.
We reserve the right to change, modify, substitute or remove, without notice, any information on this site as necessary. Methods of Payment We accept Visa, MasterCard, Maestro, Solo and Delta. You will need to supply the last three digits from the security code printed on the rear of the card, and the correct billing address for the card. You may also need to include the card issue number or start date. If you order by off-line you may also pay by cheque. Please make cheques payable to Martin Wishart limited and write your name and address on the back of the cheque. Cheque orders will not be processed until payment has been cleared.
All prices are inclusive of VAT (where applicable) at the current rate and are correct at the time of input. Some products contain some zero rated goods and the consolidated VAT rate is then reduced accordingly. We reserve the right to amend prices subject to change in the rate of duty. The total cost of your order is the price of the products plus delivery charges as quoted on the order confirmation page of the website. The displayed price is the amount in pounds sterling that you will pay. If you are paying with a non-UK bank card, the appropriate exchange rate will apply.
All orders are positively credit card sanctioned prior to dispatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given.
In the unlikely event that your payment card is used fraudulently to make a purchase with the Cookschool’s Mail Order Service you, the consumer, are entitled to cancel the said payment(s). If payment has already been made, you, the customer, are entitled, in accordance with the standing Consumer Protection Distance Selling Regulation (2000), to a re-credit or to have all sums returned to you by the card issuer.
Cook School Voucher Validity
The cook school vouchers are valid for 12 months from the date of purchase after which they are null and void. Please note that once the expiry date has been reached, the voucher cannot be extended.
Vouchers may only be redeemed once and may not be exchanged for cash value or refunded in any way (except in accordance with our cancellation policy set out below).
Prices will be as stated on our website as at the date of order. Vouchers issued for a specific class type will not be subject to any price increases, provided the voucher is redeemed against the correct class type prior to expiry of the voucher. Vouchers for day courses may be used to book higher value classes (e.g. guest chef classes). However such bookings will be subject to any price increases imposed prior to redemption and such increases and the difference in price between the two class types will require to be paid at the time of booking.
When booking a class using a voucher it will be necessary to verify the security code on the voucher along with other requested security information.
Lost vouchers will not be reimbursed or replaced without proof of sale and security code confirmation.
The gift voucher must be presented upon arrival when redeeming the experience. No photocopies will be accepted. Advance bookings are necessary.
Cancellation policy
An administration fee will be charged for cancellation of a booked class. A fee of £10 per class will be charged for a cancellation with more than 28 days notice. A fee of 25% of the total booking cost will be charged if the cancellation is between 7 and 28 days notice and a fee of 50% of the total booking cost will be charged if the cancellation is between 48 hours and 6 days notice. No refund will be given for a cancellation within 48 hours notice of the booked class. Please note that refunds due to cancellation will be made in the form of cook school vouchers.
For cancellation of a booking made using a voucher, the cancellation charge must be paid at the point of cancellation, or will be deducted from the voucher value.
In the unlikely event of a class being cancelled those customers who are affected will be offered an alternative class at the most convenient and suitable time. Scheduled classes will only be cancelled in the event of unavoidable circumstances beyond our reasonable control. The school accepts no responsibility for personal expenses such as booked transport or accommodation in such circumstances.
Should you be unhappy with your voucher, please return it to us within 7 days of the date of issue and we will provide a full refund on receipt of the returned voucher. To request a refund please call 0131 555 6655.
Liability
To the extent permitted by law, the Cook School hereby expressly excludes: (i) all conditions, warranties and other terms which might otherwise be implied by statute or common law; and (ii) any liability for any direct, indirect or consequential loss or damage, including, without limitation any liability for loss of income or revenue, loss of business and loss of profits or contracts.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
Provisional bookings
Provisional bookings can be made for classes but will only be held for 48 hours before the spaces are re-sold. To confirm a provisional booking, payment in full is required in advance of expiry of such 48 hour period. Provisional bookings will only be taken in excess of 21 days before the requested class.
Allergies and dietary requests
Our team will try to accommodate any requests or allergies if informed 7 days prior to the actual class taking place. We are unable to guarantee that our classes are suitable for food allergy sufferers. Allergies are the responsibility of the sufferers and not of the Cook School. We are unable to take responsibility for allergic reactions to any kind of food.
Minors attending classes
Children below the age of 16 years old attending a class require to be accompanied by an adult. We are unable to provide tuition to children under the age of 12 years.
Rates
Printed prices are correct at time of going to press. We reserve the right to change prices at any time, which will be published on our website.
These terms and conditions are subject to change. If we make any substantial changes these will be notified to customers by posting a prominent notice on our website.
Privacy Statement
We are committed to protecting your privacy and security as our customer. We are obliged by the Distance Selling Directive, the Data Protection legislation and all current Trade and Legal precedence and policies to respect your wishes.
From time to time we may use the information gathered in order to send you promotional information from the Cookschool by Martin Wishart or Restaurant Martin Wishart. We have however, within Cookschool's Mail Order Service, adopted a policy allowing you to opt out at any time. You can at any time 'contact us' and we will opt you out of any aspect of our marketing programme.
We collect information about you for two reasons: firstly to process your order and secondly, to provide you with the best possible service. We never give your details to any other person or company.
We collect the following information from your order: name, email address, credit card billing address, credit card information, and telephone number and order history. This information will be used to process orders and, if necessary, to contact you regarding the status of your orders. We never collect other sensitive information about you.
Restaurant Voucher Validity
This gift voucher features a unique reference ID code, may only be redeemed once, may not be exchanged for cash, replaced if lost and is not transferable. The gift voucher must be presented upon arrival when redeeming the experience. No photocopies will be accepted. Advance bookings are necessary.
